Judge’s Ruling Against Abortion Pill Is Filled With Activists’ Language
PAGE 11
Girls who’ve aborted a baby — particularly by means of chemical abortion medication that necessitate the girl seeing her aborted baby as soon as it passes — typically expertise disgrace, remorse, anxiousness, despair, drug abuse and suicidal ideas due to the abortion.
Remedy abortion is utilized in early pregnancies, usually earlier than gestation at 12 weeks, and the tissue that passes out of a affected person’s physique is commonly within the type of blood clots. Sufferers cite various causes for having abortions, however a number of research and surveys have recommended that sufferers typically really feel aid and expertise fewer psychological well being signs like despair, anxiousness and suicidal ideas after terminating pregnancies they felt unprepared or unable to deal with.
PAGE 13
Defendants contend that plaintiffs’ theories of standing “rely on layer after layer of hypothesis.” However plaintiffs allege F.D.A.’s chemical abortion routine “triggered” intense negative effects and vital problems for his or her sufferers requiring medical intervention and a spotlight.
Decide Kacsmaryk’s opinion cites a handful of research, a number of carried out by anti-abortion organizations, that the plaintiffs within the case submitted as proof. The choose devotes little consideration to the scores of research which have proven remedy abortion may be very protected and that problems are uncommon, with sufferers needing hospitalization in fewer than 1 % of instances.
PAGE 15
Contemplating F.D.A.’s 2021 resolution to allow “mail-in” chemical abortion, many ladies and ladies will eat mifepristone with out doctor supervision. And in maternity-care “deserts,” ladies could not have prepared entry to emergency care. In sum, there are fewer security restrictions for ladies and ladies in the present day than ever earlier than. Plaintiffs have good causes to imagine their alleged accidents will proceed sooner or later, and presumably with better frequency than prior to now.
In 2021, the F.D.A. completely lifted a requirement that sufferers receive mifepristone in individual from a supplier, citing years of research indicating this alteration could be protected. The drug nonetheless must be prescribed by a licensed well being supplier, however not essentially by a doctor. For years earlier than the rule was lifted, mifepristone was the one drug that the F.D.A. required to be obtained in individual from a medical supplier however that didn’t have to be taken within the presence of a supplier — it could possibly be taken at dwelling or anyplace the affected person selected. Consequently, the F.D.A. and medical specialists would dispute the choose’s rivalry that the 2021 rule change would create better security dangers, particularly since critical problems with mifepristone are uncommon.
PAGE 22
F.D.A.’s 2016 and 2021 modifications thus considerably departed from the company’s unique approval of the abortion routine. F.D.A. repeatedly altered its unique resolution by eradicating safeguards and altering the regulatory scheme for chemical abortion medication.
One other level of rivalry in Decide Kacsmaryk’s order facilities on the statute of limitations to file a lawsuit difficult the F.D.A.’s approval of a drug, which is six years. The F.D.A. accredited mifepristone in 2000 and eased sure restrictions on the capsule in 2016 earlier than lifting the in-person requirement in 2021. The Justice Division argued that it’s too late to file a lawsuit difficult the 2000 and 2016 choices, and that solely the latest measure falls throughout the six-year restrict. Decide Kacsmaryk interpreted every change as restarting the clock to problem approval for the drug.
PAGE 34-35
The Comstock Act declares “nonmailable” each “article, instrument, substance, drug, drugs, or factor which is marketed or described in a way calculated to guide one other to make use of it or apply it for producing abortion.” 18 U.S.C. § 1461 (emphasis added). It’s indeniable that chemical abortion medication are each “drug[s]” and are “for producing abortion.” Due to this fact, federal prison regulation declares they’re “nonmailable.”
Decide Kacsmaryk depends partly upon the Comstock Act, an 1873 anti-vice regulation that barred the mailing of contraceptives and “lewd” supplies, together with medication that could possibly be utilized in an abortion. His strict interpretation of that statute conflicts with a December 2022 opinion by the Justice Division’s Workplace of Authorized Counsel, which concluded that abortion-causing medication could possibly be despatched by mail if the sender doesn’t intend for the recipient to make use of them unlawfully.

FDA bans red food dye due to potential cancer risk
The U.S. Food and Drug Administration (FDA) has officially banned red dye — called Red 3, or Erythrosine — from foods, dietary supplements and ingested medicines, as reported by the Associated Press on Wednesday.
Food manufacturers must remove the dye from their products by January 2027, while drug manufacturers will have until January 2028 to do so, AP stated.
Any foods imported into the U.S. from other countries will also be subject to the new regulation.
RED FOOD DYE COULD SOON BE BANNED AS FDA REVIEWS PETITION
“The FDA is taking action that will remove the authorization for the use of FD&C Red No. 3 in food and ingested drugs,” said Jim Jones, the FDA’s deputy commissioner for human foods, in a statement.
“Evidence shows cancer in laboratory male rats exposed to high levels of FD&C Red No.3,” he continued. “Importantly, the way that FD&C Red No. 3 causes cancer in male rats does not occur in humans.”
The synthetic dye, which is made from petroleum, is used as a color additive in food and ingested drugs to give them a “bright cherry-red color,” according to an online statement from the FDA.
The petition to ban the dye cited the Delaney Clause, which states that the agency cannot classify a color additive as safe if it has been found to induce cancer in humans or animals.
The dye was removed from cosmetics nearly 35 years ago due to potential cancer risk.

“This is a welcome, but long overdue, action from the FDA: removing the unsustainable double standard in which Red 3 was banned from lipstick but permitted in candy,” said Dr. Peter Lurie, director of the group Center for Science in the Public Interest, which led the petition effort, as reported by AP.
Dr. Marc Siegel, clinical professor of medicine at NYU Langone Health and Fox News senior medical analyst, applauded the FDA’s ban.
“It was a long time coming,” he told Fox News Digital. “It’s been more than 30 years since it was banned from cosmetics in the U.S. due to evidence that it is carcinogenic in high doses in lab rats. There needs to be a consistency between what we put on our skin and what we put into our mouths.”
“There needs to be a consistency between what we put on our skin and what we put into our mouths.”
Siegel said he believes the FDA’s decision could be tied to the incoming new head of the Department of Health and Human Services, Robert F. Kennedy Jr.
“They knew it would have happened anyway under RFK Jr.,” he said. “It is already banned or severely restricted in Australia, Japan and the European Union.”
The food additive also “drew kids in” to a diet of empty calories and ultraprocessed foods, Siegel added.
“It has also been linked to behavioral issues in children, including ADHD.”
Nearly 3,000 foods are shown to contain Red No. 3, according to Food Scores, a database of foods compiled by the Environmental Working Group.

The National Confectioners Association provided the below statement to Fox News Digital.
“Food safety is the number one priority for U.S. confectionery companies, and we will continue to follow and comply with FDA’s guidance and safety standards.”
The petition to remove Red No. 3 from foods, supplements and medications was presented in 2022 by the Center for Science in the Public Interest and 23 other organizations and scientists.
