State says health care boards don’t want Idaho Supreme Court to delay abortion ban – Idaho Capital Sun
Three of Idaho’s well being care licensing boards have requested the Idaho Supreme Courtroom to not delay the implementation of Idaho’s abortion ban whereas a lawsuit towards the ban makes its manner by way of the court docket.
Hearings are scheduled for Aug. 3 in two completely different lawsuits over Idaho abortion legal guidelines. In each circumstances, Deliberate Parenthood Nice Northwest and considered one of its Idaho abortion suppliers, Dr. Caitlin Gustafson, sued the state and numerous folks and entities concerned within the implementation of the legislation.
Deliberate Parenthood named the Idaho Board of Medication, Idaho Board of Nursing and Idaho Board of Pharmacy in its most up-to-date lawsuit — over Idaho’s “set off legislation” that criminalizes abortion companies — as a result of these boards can droop and revoke well being care practitioners’ licenses as soon as the ban takes impact.
The boards oversee the training, coaching and licensure of most of Idaho’s major care suppliers, together with those that present abortion care or have sufferers who could search abortions. The boards don’t characterize docs, nurses or pharmacists in the way in which {that a} commerce affiliation does — like advocating for his or her members earlier than the Idaho Legislature.
However their mission places them in a novel place in the case of the abortion legislation. The boards are charged with guaranteeing the professionals they license are offering protected and high quality well being care to sufferers. Additionally they, imminently, will probably be liable for guaranteeing these professionals don’t present abortions beneath a legislation that some well being care suppliers argue is simply too imprecise.
”Idaho’s set off legislation lacks readability and places sufferers in danger. The IAFP is anxious about any rush to implement the legislation, particularly because it lacks readability in necessary facets of delivering reproductive well being care.”
– Liz Woodruff, govt director of Idaho Academy of Household Physicians
The Idaho Board of Medication, Idaho Board of Nursing and Idaho Board of Pharmacy final week requested the Idaho Supreme Courtroom to disclaim Deliberate Parenthood’s request to place the legislation on maintain in a June 29 submitting written by Idaho Deputy Legal professional Normal Dayton P. Reed whereas the lawsuits are going by way of the court docket course of.
“There are not any proceedings to arrest: no court docket or board has ever utilized (the legislation),” wrote Reed, representing the state and the boards. “And the (request to delay implementation) seeks to arrest the proceedings of third events who aren’t respondents on this case: all Idaho Courts and legislation enforcement officers.”
The Idaho Capital Solar requested the Idaho Legal professional Normal’s Workplace and the Division of Occupational and Skilled Licenses whether or not the boards’ members or govt director had been consulted earlier than the state made its newest submitting within the case.
“We gained’t have touch upon that side,” mentioned Scott Graf, public data officer for the AG’s workplace.
“I can’t touch upon any pending litigation,” mentioned Bob McLaughlin, public data officer for the Division of Occupational and Skilled Licenses, the umbrella company that now consists of all of Idaho’s licensing boards.
Though the boards have their very own attorneys, additionally they are state entities. So, they are often represented by the Idaho legal professional basic.
“The Board of Medication, Board of Pharmacy, and Board of Nursing are being represented by the Idaho Workplace of Legal professional Normal,” McLaughlin mentioned. “The state’s place will probably be set forth in pleadings filed (to) the court docket.”
Idaho’s abortion ‘set off legislation’ handed in 2020
Idaho’s “set off legislation” was handed by the Idaho Legislature and signed by Gov. Brad Little in 2020. It makes abortion companies a felony crime and takes impact 30 days after the U.S. Supreme Courtroom has formally overturned the constitutional proper to abortion beneath Roe v. Wade.
That would imply that, until the Idaho Supreme Courtroom had dominated on the Deliberate Parenthood lawsuit by mid-August, abortion suppliers may very well be topic to self-discipline for his or her work.
Anybody who performs or makes an attempt to carry out an abortion will be convicted of a felony with a sentence of two to 5 years in jail.
”The treatment sought by petitioners needs to be sought within the legislature or the poll field.”
– Dayton P. Reed, Idaho deputy legal professional basic, in a authorized submitting within the Idaho Supreme Courtroom case over Idaho’s abortion set off legislation
If they’re prosecuted, an abortion supplier can defend themselves by exhibiting the abortion met sure standards:
- to “forestall the demise of the pregnant lady”
- was carried out in a manner that “supplied one of the best alternative for the unborn youngster to outlive”
- if the pregnant lady, or the lady’s guardian or guardian, experiences an “act of rape or incest to a legislation enforcement company” and provides the physician a replica of the police report
Nonetheless, the well being care supplier can be required to show in court docket that the abortion was, extra probably than not, allowed beneath these exceptions.
There additionally is not any exception when a affected person searching for an abortion threatens to hurt or kill themselves if they can’t terminate the being pregnant.
Medical doctors and different well being care suppliers who violate the legislation — performing, trying or helping an abortion — additionally face skilled self-discipline. Their licenses can be suspended for at the least six months on the primary violation, and can be completely revoked in the event that they violate the legislation once more.
For at the least the previous decade, it has been very uncommon for the Idaho Board of Medication, Idaho Board of Nursing or the Idaho Board of Pharmacy to revoke a license completely.
How will Idaho’s abortion legislation apply in real-life circumstances?
Idaho’s well being care suppliers are nonetheless making an attempt to determine how the legislation will apply in real-life conditions.
Abortions will be supplied, in principle, by any physician who’s skilled in abortion care. Not all docs do carry out abortions by way of drugs or surgical procedure, although.
However the legislation could have an effect on the apply of many household docs, obstetricians and gynecologists — whose sufferers have, for many years, been ready to decide on whether or not to finish a being pregnant, both as a result of it’s unplanned or for medical or different causes.
Dr. Loren Colson is a household drugs physician who offers his sufferers being pregnant counseling which incorporates abortion as an possibility.
“The query for us turns into: When is it thought of crucial to forestall the demise of the pregnant lady?” Colson mentioned. “Is it when there’s a complication they might die from? Or (is it when abortion would) forestall a complication they might die from?”
Sufferers can have problems that he says are unclear within the legislation: ectopic pregnancies, deadly chromosomal abnormalities, ladies with a excessive danger of life-threatening situations like pre-eclampsia, or conditions when water breaks prematurely — placing each sufferers prone to an infection or sepsis, and requiring the mom to both ship a fetus that may’t survive exterior the womb or attempt to stall supply and hope antibiotics can stall an infection.
There are circumstances when water breaks prematurely, and the affected person should both ship or attempt to maintain off supply and hope that antibiotics forestall an infection or sepsis.
The Idaho Academy of Household Physicians “may be very involved” about how the legislation will have an effect on docs and their skill to take care of sufferers.
“Idaho’s set off legislation is so imprecise as to end in a collection of grey areas within the supply of care to pregnant sufferers,” mentioned Liz Woodruff, govt director of the Idaho Academy of Household Physicians.
It’ll probably result in confusion about how one can deal with situations resembling:
- miscarriages wherein the fetus dies however doesn’t depart the uterus;
- deadly situations in a creating fetus, resembling when a significant organ just like the mind by no means develops;
- and ectopic pregnancies, that are non-viable and harmful as a result of the fertilized egg is lodged in a fallopian tube.
In a press release June 24, the academy mentioned it “strongly opposes any exterior interference in (the well being care) course of because it conflicts with the elemental medical precept of affected person autonomy and infringes upon the patient-physician relationship.” The coverage additionally would “criminalize the patient-physician relationship and inhibit the supply of protected and well timed complete care,” it mentioned.
The legislation “will complicate the supply of well timed medical care, placing physicians in precarious authorized conditions and due to this fact placing sufferers in danger,” Woodruff mentioned.
Concerning the well being care boards
The boards of drugs, nursing and pharmacy have authority over most of Idaho’s well being care professionals. That features docs, doctor assistants, nurse practitioners, nurses, pharmacists and others who take care of Idaho sufferers.
The boards would not have authority over sure different professions, resembling midwives who don’t have a nursing license.
The boards are composed largely of individuals licensed in every career, and a small variety of members who characterize the general public or different stakeholders.

So where are Idahoans headed for the Thanksgiving holiday this year? This time around Anaheim, Las Vegas, Salt Lake City, Seattle, Honolulu, Phoenix, San Diego, Bend, Ft. Lauderdale and Jackson are the Top 10 domestic destinations for Idahoans. Some of these cities are destinations that will keep the family busy. Others are relaxation destinations. Each of them offers something cool in their own right, but unfortunately there are several that have the dishonor of being on the list of the most “Bed Bug Infested Cities in America.”
How Dangerous are Bed Bugs?
These little blood suckers aren’t known to spread diseases like West Nile Virus or Dengue like mosquitoes do. They’re more annoying than anything else. The CDC explains that if you become a bed bug buffet overnight, you may not realize it when you wake up. Before enjoying your blood, bed bugs inject you with an anesthetic and an anticoagulant so it’s highly unlikely that the bite would wake you up or leave behind evidence that you were bleeding. A few days later, those bites may swell or become itchy like other bug bites. Bed bugs have also been linked to more serious, non-visible symptoms like insomnia and anxiety.
Why Are Bed Bugs a Travel Concern?
Well, bed bugs are sneaky travelers themselves. Their bodies are skiing and flat, which means they can creep into everything from seams of your luggage, to folds of your clothes or inside a pillowcase on the pillow you brought from home. They can go quite a while without feeding, so they’ll just hang out and wait till you unpack your belongings at home. That’s when they’ll emerge, enjoy you as a meal again and start to spread in your bedding, furniture or other areas of your home.
When you travel to areas known to have a high infestation, your risk of bringing them home rises. This list is important to check because bed bugs aren’t prejudiced. They’re just as likely to infest an upscale room at a luxury hotel as they are college dorm rooms and homeless shelters.
How Can I Tell If My Room Is Infested with Bed Bugs?
They’re tiny, so detecting them with just your eyes can be difficult. They’re also known to hide in more areas than we listed above. Cracks, crevices, indentations in headboards or behind wallpaper are also popular hiding spots for bed bugs. The most tell-tale sign that a room has a bed bug issue is rusty colored blood spots on the mattress or furniture. (And if you’re not asking questions about blood stains in your hotel room or Airbnb, we’ve got questions for you.) You may also find their molted exoskeletons or smell a sweet, musty odor.

Seattle ranks as the #4 most popular Thanksgiving destination for Idahoans this year. It also ranks #44 for bed bugs.
What happens in Vegas may stay in Vegas…except for bed bugs. Vegas is the second most popular Thanksgiving destination for Idahoans and made the bed bug report for the first time. You’ll find Sin City at #35.
And finally we say “three-ish” because while Anaheim, Idaho’s #1 destination Thanksgiving 2024 doesn’t appear on the list, but nearby Los Angeles does. They’re #5 for bed bugs!

NIC enrollment climbs after fall count
Enrollment at North Idaho College grew 15% since last fall, according to State Board of Education data.
There are 4,585 students at the college this October, up from 3,979 in 2023 and 4,296 in 2022. However, the college is still 3% down in overall enrollment from four years ago.
The growth comes as NIC fights to retain accreditation from the Northwest Commission on Colleges and Universities. The college Wednesday welcomed three new trustees, who ran on a platform of retaining accreditation and creating stability for the school.
The numbers continue a jump noted in August, after enrollment increased for the first time in more than a decade. In 2011, NIC had 6,750 total students.
The October numbers capture both full-time students, at 1,209, and part-time students at 2,898, an 18% increase. The part-time list includes high school students taking dual-credit classes. There are 478 students enrolled in career-technical programs — a 14% increase from last year, but a 22% decrease from four years ago, when 612 students took CTE courses.
Tami Haft, NIC’s dean of enrollment services, presented the enrollment data to NIC trustees Wednesday, and audience members applauded the news of enrollment increases. Haft noted that the college attracted 211 new students, a 37% rise in new student enrollment.
Here’s how NIC’s student enrollment breaks down:
- 47% of students are in programs to transfer to a four-year university.
- 38% are in dual-credit courses.
- 10% are in career-technical education.
- 5% are in non-degree programs.
