Delaware’s Democratic Governor Vetoes Bipartisan Bill To Protect Medical Marijuana Patients’ Gun Rights
Delaware’s Democratic governor has vetoed a invoice meant to make clear that medical marijuana sufferers should not prohibited from shopping for, possessing or transferring firearms beneath state legislation.
Gov. John Carney (D), one of many solely Democratic governors who stays vocally against adult-use hashish legalization, vetoed the laws, HB 276, on Thursday. The invoice from Rep. Andria Bennett (D) cleared the legislature with almost unanimous, bipartisan assist in June.
Carney, who additionally vetoed a marijuana legalization measure in Could, mentioned in a veto assertion that he felt that the medical hashish gun rights reform was redundant as a result of he says there’s nothing in state statute that renders a affected person to be a “particular person prohibited” from accessing firearms.
“HB 276, whereas meant to supply readability, doesn’t add new significant protections or rights for Delawareans,” he wrote. “Moreover, if signed into legislation, HB 276 dangers creating confusion concerning the rights of medical marijuana sufferers—beneath federal legislation—to buy firearms right here in Delaware.”
“Beneath present federal legislation, using marijuana, even for medical functions, stays unlawful. Federal legislation and background verify processes at present limit the power of a consumer of marijuana, even for medical functions, from buying a firearm. HB 276 wouldn’t ease the present rigidity between state public well being coverage and federal drug enforcement coverage, nor wouldn’t it get rid of the complexities and dangers that confront Delawareans who’re or could develop into gun homeowners and medical marijuana customers.”
“At finest, HB 276 maintains the established order,” the assertion concludes. “At worst, it dangers deceptive those that could also be impacted and rising public confusion.”
Lawmakers had been unable to get sufficient votes to overturn the governor’s determination on the adult-use legalization invoice this yr.
Carney rejected that measure regardless of the rising public assist for the reform, notably amongst voters in his personal occasion. A ballot launched final week discovered that 60 p.c of registered Delaware voters mentioned that marijuana use “needs to be authorized.”

Rep. Jeff Spiegelman (R) a cosponsor of the Second Modification laws, mentioned the governor’s citing federal legislation as a purpose to dam the invoice doesn’t maintain up, because the state’s medical hashish program itself contradicts federal coverage.
“The governor has chosen to proceed a medical program—which I assist—that’s unlawful on the federal stage however not chosen to permit individuals to maintain their rights whereas training that program,” he advised Delaware Public Media.
Carney’s veto of the gun rights invoice, first reported by Bearing Arms, stands in stark distinction to actions taken by Florida Agriculture Commissioner Nikki Fried (D), who’s actively suing the Justice Division over the federal ban on firearms for medical hashish sufferers.
Fried mentioned earlier this month that an preliminary oral listening to on the lawsuit in federal court docket went properly, together with her authorized crew doing a “compelling job” of laying out their arguments towards the ban.
In the intervening time, the present federal coverage persists, making it so individuals are denied gun purchases in the event that they’re trustworthy about their hashish use whereas filling out a Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) background verify kind—no matter state legislation.
Supporters of Fried’s lawsuit argue that the ATF requirement successfully creates an incentive for hashish customers to both lie on the shape, purchase a gun on the illicit market or just forgo a constitutional proper.
In 2020, ATF issued an advisory particularly concentrating on Michigan that requires gun sellers to conduct federal background checks on all unlicensed gun patrons as a result of it mentioned the state’s hashish legal guidelines had enabled “recurring marijuana customers” and different disqualified people to acquire firearms illegally.
There have been earlier efforts in Congress to particularly defend medical hashish sufferers towards shedding their proper to buy and possess weapons, however these efforts haven’t been enacted.

An emergency dredging project to restore severe beach erosion along a popular surfing and fishing spot north of Delaware’s Indian River Inlet began this week.
The $15 million initiative aims to restore the shoreline on the north side of the Indian River Inlet Bridge.
Two separate storms earlier this year triggered dune breaches along the coastline, closing portions of the Coastal Highway.
The project is a crucial step to protect the highway, which serves as an emergency evacuation route, according to Delaware’s Department of Natural Resources and Environmental Control.
The project will also prepare the area for the increasing intensity of storms caused by climate change, said the agency’s secretary, Shawn Garvin.
“[The area] is in a position where it tends to lose sand faster than other areas of the coastline, and does not naturally regenerate,” Garvin said. “It is at the foot of the bridge. It is a very popular area for fishing and surfing, and general beach use. So, we’re looking to try to get it back into a stable situation.”

Salty ocean water is creeping up the Delaware River, the source for much of the drinking water for Philadelphians and millions of others, brought on by drought conditions and sea level rise, and prompting officials to tap reservoirs to push the unpotable tide back downstream. Officials say drinking water isn’t imminently at risk yet, but they’re monitoring the effects of the drought on the river and studying options for the future in case further droughts sap the area, per the AP.
- What is the salt front? The salt front, or salt line, is where salt water from the ocean and fresh water meet in the river. That boundary is typically somewhere around Wilmington, Delaware, but the recent drought has pushed it about 20 miles north.
