Delaware House votes to raise minimum gun purchase age to 21
DOVER, Del. — Home lawmakers have accepted a invoice elevating the minimal age for anybody in Delaware to legally possess or buy any rifle, or firearm ammunition, from 18 to 21, the identical age requirement for handguns.
The invoice cleared the Home 27-13 on a largely party-line vote Tuesday after being amended to exempt members of the Nationwide Guard and to make clear that an individual below 21 might nonetheless use a gun for self-defense if the usage of such power is justifiable below state regulation. The laws, a part of a package deal of gun restrictions that Gov. John Carney and fellow Democrats are pushing to move by the top of this month within the wake of current mass shootings in different states, now goes to the Democrat-controlled Senate.
The invoice doesn’t apply to shotguns or muzzleloaders and permits possession of a firearm by an individual below 21 for searching or different leisure exercise whereas below the direct supervision of an individual 21 or older.
“18 to 21 doesn’t imply you possibly can’t use that gun. It’s important to be supervised, and you can’t go purchase one,” mentioned Home Speaker Pete Schwartzkopf, chief sponsor of the laws.
Schwartzkopf, a Rehoboth Democrat, additionally sponsored the modification clarifying that an individual below 21 can use a gun in self-defense if that lethal power is justified below the provisions of Delaware’s prison code.
“Our self-defense doctrine in our state would permit them to do this, however I needed to make it completely clear,” mentioned Schwartzkopf, citing considerations raised throughout a committee listening to final week.
“This mainly tells anyone that for those who’re dwelling and also you’re in peril, you should use no matter you have to use, whether or not or not it’s a gun that you just’re not alleged to have possession of, or something, in self-defense,” he defined.
Democrats additionally agreed to exempt Nationwide Guard members from the laws, which already included exemptions for law enforcement officials, energetic members of the navy, and holders of concealed-carry permits.
They rejected GOP proposals to exempt rimfire rifles and ammunition, folks below age 21 who personal actual property or who’ve been married for not less than six months, and people who have obtained written consent from a guardian or guardian to purchase a gun.
“I feel we’re going to make criminals out of younger adults making an attempt to start out households,” mentioned Minority Chief Danny Quick, a Seaford Republican.
In the meantime, Home lawmakers voted unanimously Tuesday for laws placing state regulation enforcement officers in command of background checks for gun purchases.
A invoice accepted Tuesday and despatched to the Senate would resurrect Delaware’s Firearm Transaction Approval Program, which was eradicated greater than a decade in the past when lawmakers voted to depend on the federal authorities’s Nationwide Instantaneous Legal Background Test System, or NICS.
That vote got here amid considerations on the time that Delaware’s background examine system was not offering NICS with details about mentally in poor health people prohibited from shopping for or possessing firearms. The invoice licensed state companies to offer such info to NICS, created a federally mandated program permitting people beforehand deemed mentally in poor health to re-establish their eligibility for gun possession, and abolished the state’s current background examine system as redundant.
Lawmakers now need to reverse course amid considerations that NICS could not seize folks prohibited below Delaware regulation from possessing firearms, together with folks convicted of home violence misdemeanors and people topic to excellent warrants.
The invoice requires the State Bureau of Identification to be the purpose of contact between gun sellers and the federal databases checked by the FBI. The SBI would thus grow to be answerable for figuring out whether or not an individual is prohibited from receiving or possessing a firearm below state or federal regulation, and would have the ability to search different databases apart from NICS in making that dedication.

Autumn’s newest tradition: The Delaware Fall Festival at Battery Park
The story behind the Kalmar Nyckel
Here’s the story behind the Kalmar Nyckel, the Swedish Mayflower of the Delaware Valley. 10/29/24
Sunday’s autumn weather was perfect for the inaugural Delaware Fall Festival.
The event took place at Battery Park in the historic Old New Castle area of New Castle, providing the ideal setting for a community gathering and a worthy cause.
The free event was organized to raise funds and awareness for the New Castle Outdoor Recreation Coalition’s planned expansion of the park’s playground. Phase 2 of the Battery Park Playground Project will feature a replica of the Kalmar Nyckel, the Swedish flagship that brought settlers who established the first permanent European settlement in the Delaware Valley in 1638.
The festival featured live entertainment, children’s activities, and various food vendors.
Renee Duval, a three-year resident of New Castle, attended the festival with her husband and two children. As regular visitors to Battery Park who often stroll the path near Deemers Beach, they were excited to explore the event after hearing about the food trucks, music, and vendors.
Among the vendors was Theresa Batts, owner of Batts Concessions from Hartford County, Maryland, who learned about the festival through social media. She said the timing was perfect. She and her husband prefer to sell on weekends, but it is very hard to find events on a Sunday. And this weekend, they were celebrating their business’s first anniversary. Batts Concessions offered an array of treats, including kettle corn, homemade peanut brittle, various nuts, and cotton candy. When asked how sales were going, Batts replied, “Fantastic. No complaints. We would definitely do it again next year.”
Delaware Fall Festival organizers hope to make this an annual tradition for the historic waterfront community.
