FARGO, N.D. (Valley News Live) – North Dakota’s statewide kratom ban is now in effect. The ban comes after kratom was linked to two deaths in Fargo last month alone and 50 deaths across North Dakota since 2019 — 23 of which list kratom or its derivatives as a primary cause.

Kratom, which is native to Southeast Asia, has been sold openly in convenience stores, gas stations, and smoke shops across the state with no age restrictions or regulations — and with no regulatory body verifying what’s actually inside each product. Under the new ban, anyone caught selling, possessing, or using kratom faces a fine of up to $1,000.

Gov. Kelly Armstrong signed an executive order Tuesday also classifying 7-hydroxymitragynine, known as 7-OH, as a Schedule 1 controlled substance, placing it in the same category as heroin and LSD. The governor has called a special legislative session for Sept. 2 to codify the ban into state law.

Fargo Police: Enforcement Starts Now

Fargo Police Lt. Tom Shaw said officers are already working to ensure compliance, but acknowledged the process will take time.

“We need people to stop using it because if we come across them and they’re selling it or using it, it’s an infraction; they could have to pay a fine of $1,000,” Shaw said.

Shaw warned that penalties could increase significantly after the Sept. 2 special session.

“Similar to other controlled substances, you could be looking at a lot higher fine; you could potentially be looking at jail time for possession of this,” Shaw said. “We don’t know until they’re done. But now is the time to stop using it, period.”

Shaw also noted that identifying kratom products in the field presents a challenge for officers, saying enforcement will involve “a little bit of trial and error.”

Natural Kratom vs. Synthetic Derivatives

The distinction between natural kratom leaf and synthetic derivatives like 7-OH is now at the center of a debate over whether North Dakota’s sweeping ban went too far. Matthew Lowe, Executive Director for the Global Kratom Coalition, said the process of concentrating certain compounds fundamentally changes the substance.

“They’ll amp up the potency by a thousand times. They strip it of all the other alkaloids that give it its mitigating effects — and suddenly, you move from a natural botanical to something new, something entirely different,” Lowe said.

Medical Expert Raises Concern About Abrupt Ban

While supporting long-term regulation, Robert Cole Pueringer, M.D., a medical toxicologist at Essentia Health in Duluth, Minn., expressed concern that removing kratom from the market too quickly, without proper education, could drive users toward a far more dangerous substance.

“If we regulate, take kratom out of the market immediately or quickly without any education, people are going to turn to fentanyl, and fentanyl is what kills everyone,” Pueringer said.

Pueringer explained that kratom’s active ingredient, mitragynine, acts as an opioid in the body and can lead to dependency and severe withdrawal.

“Kratom can absolutely lead to a use disorder, or an opioid use disorder and often progresses to fentanyl use. So that is the big concern is that: people can develop an opioid use disorder or kratom use disorder and that if you stop taking it, you’ll go through this wicked withdrawal,” Pueringer said.

He said users need to know that treatment options, such as buprenorphine, are available.

“If we take away kratom, which needs to happen, we just need education in place so that prescribers can prescribe buprenorphine, and that patients know that something like that is available so that they don’t turn to fentanyl,” Pueringer said.

What’s Next

The North Dakota Legislature is set to convene in special session Sept. 2 to address long-term enforcement authority and potentially stiffer penalties for kratom possession and sale.

Retailers who sell kratom are advised to remove affected products from shelves immediately and can drop them off at local law enforcement agencies or MedSafe sites at certain pharmacies — about 200 locations statewide. Retailers with questions can contact the North Dakota Board of Pharmacy.

If there is a warning out, that means blooms are covering a significant portion of the water, and toxin levels are past a healthy limit.

“In terms of human health … you have skin irritation, sore throat, headache, diarrhea, vomiting,” said Brian Houle, scientist with the state Department of Environmental Quality. “You can actually get respiratory illness. It can be airborne. In terms of animals, it can be fatal to animals.”
