Supreme Court OKs law letting Texas police arrest migrants suspected of illegally crossing border
The Supreme Court on Tuesday allowed Texas to enforce a law that allows local police to arrest migrants suspected of crossing the border illegally – marking a significant but temporary win for the state’s efforts to control illegal immigration across the border with Mexico.
The ruling comes a day after the court extended a block on the state law at the request of the Biden administration, which sued to strike down the measure. The Biden administration argued that the law, known as Senate Bill 4 and signed by Gov. Greg Abbott in December, would usurp federal authority on matters related to immigration enforcement. It marked the most significant effort by a state to take control of enforcement since the court struck down parts of an Arizona law in 2012.
“The United States brings this action to preserve its exclusive authority under federal law to regulate the entry and removal of noncitizens,” the DOJ lawsuit filed in January states. “Texas cannot run its own immigration system. Its efforts, through SB 4, intrude on the federal government’s exclusive authority to regulate the entry and removal of noncitizens, frustrate the United States’ immigration operations and proceedings, and interfere with U.S. foreign relations.”

Texas said the state’s law mirrored federal law and was put in place to compensate for the Biden administration’s inadequate response at the southern border.
“Texas has defeated the Biden Administration’s and ACLU’s emergency motions at the Supreme Court. Our immigration law, SB 4, is now in effect. As always, it’s my honor to defend Texas and its sovereignty, and to lead us to victory in court,” Texas Attorney General Ken Paxton said in a statement on Tuesday.

The ruling was not focused on the merits of the case itself but on the stay on the law issued by the Fifth Circuit Court of Appeals, which had blocked the law in February from taking effect. The court did not explain its reasoning for ending the stay, but in a concurring opinion, Justices Amy Coney Barrett and Brett Kavanaugh expressed concern about the moves by the appeals court – and suggested it could rule differently on the merits itself.
“Before this Court intervenes on the emergency docket, the Fifth Circuit should be the first mover,” Barrett wrote.
“So far as I know, this Court has never reviewed the decision of a court of appeals to enter — or not enter — an administrative stay. I would not get into the business. When entered, an administrative stay is supposed to be a short-lived prelude to the main event: a ruling on the motion for a stay pending appeal,” she wrote.
Justices Sonia Sotomayor and Ketanji Brown Jackson issued a scathing dissent, accusing their conservative counterparts of inviting “further chaos and crisis in immigration enforcement.”

“Texas passed a law that directly regulates the entry and removal of noncitizens and explicitly instructs its state courts to disregard any ongoing federal immigration proceedings. That law upends the federal state balance of power that has existed for over a century, in which the National Government has had exclusive authority over entry and removal of noncitizens,” Sotomayor said.
The White House said it “fundamentally” disagreed with the Supreme Court’s order.
“S.B. 4 will not only make communities in Texas less safe, it will also burden law enforcement, and sow chaos and confusion at our southern border. S.B. 4 is just another example of Republican officials politicizing the border while blocking real solutions,” the White House said in a statement.
The case now goes back to the Fifth Circuit, which could block the law again, setting up another Supreme Court battle. Abbott called the ruling a “positive development” while acknowledging that there will be hearings in the appeals court.

The ongoing legal battle marks the latest in a number of clashes between the state and the government on how to handle the ongoing crisis at the border. The DOJ sued Abbott’s administration this year over its construction of a floating barrier on the Rio Grande.
The DOJ also requested that the Supreme Court intervene in its dispute with Texas over the construction of razor wire at the border. Texas had sued the DOJ after federal officials cut and destroyed the wire in order to take migrants into Border Patrol custody. The Supreme Court in January allowed the wire to be taken down as the legal challenge continues.

That dispute was followed by a stand-off in Eagle Pass, Texas, in which Texas took over Shelby Park – a key crossing area – and refused to allow federal officials access. The Biden administration subsequently threatened to sue over the lack of access.
It comes as border security and the migrant crisis at the southern border looks set to be a top political issue in the 2024 elections. Both President Biden and his opponent, former President Trump, recently visited Texas, with Trump promising to launch a mass deportation operation if elected and with Biden urging Congress to pass a bipartisan border funding deal that includes more staffing at the border and money for NGOs and cities receiving migrants, as well as an expulsion authority if migration reaches a certain level.

Whataburger revives iconic A-frame design at new Texas restaurants
Aiming for a modern-yet-retro look, Whataburger is reviving its iconic A-frame. Sort of.
The Texas burger chain is introducing two new prototype store designs, each of which is “grounded in the brand’s heritage but built for how [customers] experience Whataburger today,” the company says. The designs will be incorporated into newly built locations.
One of the prototypes, called The Legacy, reintroduces the classic A-frame shape, but with a modern twist, on the exterior of a 3,000-square-foot store and enlarges the dining room, the company says. The new A-frame treatment maintains “the unmistakable Whataburger look with bold architectural updates,” says the burger chain, but it takes up far less space than the original version.
The other prototype, called The Essential, leans into the iconic orange-and-white striped scheme on the exterior of a 2,000-square-foot restaurant.

In 2020, Whataburger debuted its first refreshed store in South San Antonio, de-emphasizing the familiar A-frame, adding more glass around the front of the building, updating the décor, and retooling the kitchen. In the six years since, most of Whataburger’s original A-frame-adorned “flying W” stores have switched to new formats, and all newly built locations have incorporated modern designs.
Among other changes coming to new Whataburger restaurants are:
- Warmer spaces featuring natural wood tones, more glass, and modern materials to “create a more open, welcoming environment.”
- Updated layouts with flexible seating and dedicated areas for mobile orders and third-party order pickups.
“The result is a space that feels like Whataburger from the moment you pull in, with a few thoughtful updates to make every visit even better. It’s all about honoring the brand’s roots while making room for what’s next,” the company says.
The new prototypes will debut in Texas and then be rolled out in Arizona, Florida, Georgia, North Carolina, and South Carolina. Construction is set to start later this year, and store openings are expected in early 2027.
Whataburger, founded in 1950 in Corpus Christi, operates more than 1,100 restaurants in 17 states, with the bulk of them in Texas.

Ai’King Hall’s Recruiting Flip to Miami Signals Concerning Oregon Trend
The Miami Hurricanes have become a pain for the Oregon Ducks on the recruiting trail as of late. Former Oregon coach Mario Cristobal’s Hurricanes have stolen another recruit from Dan Lanning’s Ducks as both teams enter the 2026 college football season as national championship contenders.
2027 four-star cornerback Ai’King Hall, originally a Ducks commit, flipped his commitment to Miami on Sunday afternoon. Hall is rated as the No. 73 overall player nationally and the No. 9-ranked cornerback, per 247Sports. Hall was committed to the Ducks since April 6 before flipping his commitment to the Hurricanes.
Oregon Ducks’ Other Recruiting Losses to Miami Hurricanes
In addition to flipping Hall, Miami also poached former Georgia five-star cornerback Donte Wright, whom the Ducks were pushing hard to flip. Wright committed to Miami over Oregon on May 9 and is a big loss for the Ducks, even more so than Hall, as he is among the top-ranked players in the 2027 recruiting class.
Per 247Sports, Wright is ranked as the No. 9 overall player nationally in the 2027 class and No. 1 in California. Wright is expected to be a key contributor on defense and for Cristobal’s effort to lead Miami to their first national championship since 2001.
This past season, the Hurricanes fell 27-21 to the Indiana Hoosiers in the national championship. Despite the loss, Miami is expected to be one of the top college football contenders in the future, along with Oregon.
While this pair of recruits won’t arrive in South Beach until the 2027 season, Miami and Oregon could very well face off in this year’s national championship at Allegiant Stadium in Las Vegas, Nevada.
Impact of the Oregon Ducks Losing Ai’King Hall and Donte Wright
With the losses of both Hall and Wright from Oregon’s 2027 recruiting class, the Ducks now have one cornerback commit for the 2027 cycle, four-star cornerback Josiah Molden, a native of nearby West Linn, Oregon.
Molden has the potential to be a top future talent for the Ducks’ secondary as he is ranked the No. 27 overall cornerback and the No. 1 player in Oregon, per 247Sports. Following the two losses, Oregon’s 2027 recruiting ranking remains inside the top 10, despite Lanning not having a five-star commit for the cycle.
Having both Hall and Wright in Oregon’s secondary would’ve been massive for Oregon’s defense, but for now, Lanning will have to work with what he has, while continuing to pursue other top recruits.
Oregon Ducks’ Current 2027 Recruiting Class Ranking
With the loss of Hall, Oregon’s 2027 recruiting ranking dropped slightly to No. 10 overall, per On3 and 247Sports. Before Hall decided to flip his commitment to Miami, the Ducks’ 2027 recruiting ranking was No. 9 overall, per On3 and No. 7 per 247Sports.
Despite the losses, there is still plenty of time for Oregon to improve its 2027 recruiting class ranking, the main focus for the Ducks as of now, with the return of star quarterback Dante Moore, is winning the team’s first national championship in program history.
This is an accomplishment that Oregon fans are desperate for, as Lanning has made an all-out effort for the Ducks to achieve that goal as they enter what some see as a national championship or bust 2026 season.
