Judge: Tupelo acted properly in OK of affordable apartments

TUPELO, Miss. (AP) — A decide in north Mississippi has dominated that the town of Tupelo acted correctly in approving plans for building of an affordable-housing condo advanced.

Lee County Circuit Courtroom Choose Paul Funderburk issued the ruling Thursday, the Northeast Mississippi Day by day Journal reported.

In August, the Tupelo Metropolis Council voted 4-3 to approve web site plans and growth for the 46-unit condo advanced referred to as Flowerdale Commons.

A number of residents of close by Cottonwood Estates subdivision, some enterprise homeowners and one other developer appealed the town’s determination to the circuit court docket.

Funderburk wrote that the Tupelo growth code “unequivocally” permits condo growth inside mix-use-employment districts, which the realm is zoned as, with out further necessities.

The decide disagreed that flats needed to be tied to employment amenities. He dominated that since flats are secondary use, the challenge meets the “function and intent” within the code that encourages medium-density residential housing.

The newspaper reported that Mississippi Middle for Justice filed a court docket temporary in December, supporting the town council’s determination to approve plans for the condo advanced.
