Port: As the federal government teeters on edge of shutdown, North Dakota has no vote
MINOT — Barring some late-breaking legislation, the U.S. federal government will shut down within hours.
As this drama unfolds in Washington, North Dakota has no voice in the U.S. House of Representatives. The legislative body where, per Article I, Section 7 of the U.S. Constitution, all bills raising revenue must originate.
As I write this, Speaker Mike Johnson, a Republican,
is confident
they’ll avoid a shutdown despite funding agreements getting scuttled twice in recent days. Once thanks to agitation from billionaire Elon Musk and once again thanks to a group of House Republicans who refused to agree to raise the national debt ceiling without significant spending cuts.
Given the turmoil in the House Republican caucus and the narrow margins of the Republican majority, any potential deal may pass by only a scant few votes. Which is another way of saying that, in this fraught moment, no side in the debate has any votes to spare.
But a vote from North Dakota won’t be among them. That’s because former U.S. Rep. Kelly Armstrong resigned his seat in the House on Dec. 14 so he could be sworn in as governor on Dec. 15, which
Article V, Section 5
of the North Dakota Constitution requires. Meanwhile, Rep.-elect Julie Fedorchak is waiting in the wings, but she was elected to the next Congress, not this Congress, so she cannot be seated.
I actually spoke to Armstrong about this drama
in April.
Given the resignations of other House Republicans, it seemed at that time the GOP could lose control of the House before the current Congress ended. Armstrong was confident that the party would replace members through special elections between now and then and he was right. The GOP held onto its majority, slim as it is.
As for Armstrong’s vacancy? “After June 11, we will be keeping the speaker’s office informed,” he also told me at the time, referring to the primary election.
“It’s confusing for folks because they don’t know who is our representative right now,” Fedorchak told me when I spoke to her about it.
She’s feeling flummoxed because there is nothing she can do. Fedorchak was not elected in a special election to replace Armstrong in this Congress. She was elected to fill North Dakota’s at-large seat in the next Congress.
By law, she cannot be seated in this Congress. The next Congress won’t be seated until January. Also, unlike senators, members of the U.S. House can’t be appointed. Outside of holding a special election, there’s no mechanism to fill Armstrong’s vacancy.
This circumstance isn’t anything Armstrong or Fedorchak can remedy. What’s caused it is constitutional law and dysfunction in Washington. North Dakota’s constitution necessitated Armstrong’s resignation from the House so he could be sworn in as governor. The U.S. Constitution prohibits North Dakota from appointing an interim replacement.

“This isn’t even really a budget fight,” Armstrong spokesman Mike Nowatzki told me. “It’s a CR fight. Congress should do its job and not govern by crisis.”
“He informed them when he was running for governor that this was a possibility. It shouldn’t surprise them that he had a hard out on Dec. 14,” Nowatzki added.
Which may be something for the Legislature to consider going forward. Can the new governor be sworn in at a later date? The timing is already awkward. The state constitution also mandates that lawmakers begin their regular session in January after an election. It also requires an organizational session in mid-December, complete with a budget address from the governor. This year, that was Doug Burgum, who was obliged to deliver an executive budget to lawmakers
as a lame duck just days from leaving office.
Armstrong’s feeling “is that having the governor be sworn in on the day before a legislative session wouldn’t be a good idea,” Nowatzki told me, referring to a possible delay in the swearing-in.
“It’s already a mad scramble,” Nowatzki added. “It would be exponentially more difficult.”
The situation with North Dakota’s at-large House seat is unusual. But the outgoing governor delivering a budget as a lame duck? That happens every time we get a new governor.
This timeline could be reshaped to serve the public better, but that’s easier said than done. Moving the swearing in date to a later time might mean moving the legislative session to a later start. I don’t sense there would be much appetite among lawmakers to do it, and even if there were, it would be a change to the state constitution that would have to be ratified by a vote of the people.
Meanwhile, in Washington, as Republicans fight with Democrats (and other Republicans) over the budget, North Dakotans have no official say in the matter.
GRAND FORKS — During breaks in action in the first half, UND brought out and honored Jim Kleinsasser and Digger Anderson — two former players with signature moments in the UND-North Dakota State rivalry.
On Saturday, the Fighting Hawks couldn’t find their next rivalry hero.
Instead, NDSU’s Cole Payton scored on an 8-yard run with 2 minutes, 22 seconds left in the fourth quarter as the Bison beat UND 15-10 in front of a sellout crowd of 12,749 in the Alerus Center.
No. 13 UND fell to 6-4, with four losses by a combined 14 points. The No. 1 Bison improved to 10-0, securing the Missouri Valley Football Conference title in the process.
“It hurts, right?” UND first-year head coach Eric Schmidt said. “It was one of those games where it was an ugly football game. It’s frustrating. It’s a learning process. I just think you have to continue to do the things that winning teams do, and you have to be loyal to winning. It takes what it takes every single week.”
As has been the case in all four of UND’s losses this season, the Fighting Hawks had a chance to win the game late.
UND took over at its own 29 with about 80 seconds left and no timeouts trailing by five.
Jerry Kaminski connected with B.J. Fleming, Korey Tai and Sam Strandell as the Hawks moved the ball to the Bison 28 with 15 seconds left.
On second-and-6 with time running out, Kaminski took a shot toward the end zone for Tai. The ball was intercepted by NDSU’s Anthony Chideme-Alfaro.

After throwing 22 touchdowns to two interceptions through UND’s first eight games of the season, Kaminski — a first-year starting sophomore — has thrown no touchdowns and five interceptions in the team’s current two-game losing streak.
Kaminski finished 21-for-38 with three interceptions for 170 yards and was sacked three times.
UND’s leading rusher was Sawyer Seidl, who had 23 carries for 68 yards and a first-quarter touchdown run. Seidl had a four-game streak of at least 100 rushing yards snapped against the Bison.

NDSU’s offense only managed 10 first downs.
Payton threw for 125 yards, no touchdowns and had a first-quarter pass picked off by UND linebacker Malachi McNeal, which set up the Seidl touchdown.
UND out-gained NDSU 286 yards to 268 and ran 30 more offensive plays.

The Bison were just 2-for-12 on third down.
NDSU star wide receiver Bryce Lance had three catches for 61 yards.
“Coach Schmidt was preaching to us how good those guys were and how we’re going to stop them,” McNeal said. “Coach had a really good game plan, how to approach angles on Cole Payton and how to guard Bryce Lance. I think we have a defensive coach who really knows ball and really studies them. It really helps because it helps you go out there and play fast and play confident.”
NDSU’s game-winning drive was set up when UND went for fourth-and-1 at midfield with 4:24 to play and Kaminski was stuffed on a quarterback run up the middle.
The Bison scored four plays later, with the help of a 30-yard catch by tight end Reis Kessel.
“(UND) is playing really good defense,” NDSU coach Tim Polasek said. “They played bracket coverage today, and we’ve got to have a better plan against it. We’ve got to be better. To Eric’s credit, they did a nice job adjusting. It looks like we’re going to have a hell of a chess match moving forward.”

DEVILS LAKE UPSETS KINDRED FOR FIRST TRIP TO STATE TITLE GAME SINCE 2010
KINDRED — The last time Devils Lake faced Kindred, the Vikings ran away with a 30-point win. But in Friday night’s rematch, the Firebirds flipped the script and won by 1 in overtime.
Devils Lake jumped out to a 14-0 lead before Kindred battled back to tie things up at 14 in the fourth. Quarterback Mason Palmer then found Bryar Exner for a go-ahead touchdown, but Kindred’s Myles Thielges answered with a keeper to send the game to overtime.
In the extra period, Palmer and Exner connected again to give the Firebirds the lead. Kindred scored on its next drive, but the extra point to extend the game sailed wide.
The Firebirds are heading to the Dakota Bowl for the first time in 15 years and will face Minot North.

FARGO, N.D. (Valley News Live) – November 7 marks deer opener in North Dakota, with regular firearms permitted for use through November 23.
Valley News spoke with Mike Muhonen, owner of the Outdoorsman store in Fargo, who shared tips on proper gear and tactical tools for the hunting season.
Safety first with bright orange gear
Muhonen says hunters should wear bright orange to prevent accidental shooting accidents. Bright orange lets other hunters know you are not prey and makes it easy to see you
Cold weather preparation essential
November hunting in North Dakota can involve hours of waiting outdoors in cold conditions. Muhonen suggests hunters bring a beanie, thermal underclothes, insulated socks, a heater, thick pants and thick gloves.
All of these items are available at the Outdoorsman Store in Fargo.
Tactical tools to improve success
Hunters looking to increase their chances should consider game calls and game scents, according to Muhonen.
he says It’s important to fit in, disguising the smell of human and using deer and elk sounds can improve your chances of a successful hunt.
Hunting regulations apply
Hunters must follow North Dakota hunting regulations. According to North Dakota law and the recommendation of the Game and Fish Director, open seasons are declared for taking deer with bow, firearms, muzzleloader and during youth deer season.
Except as provided by law, no person shall hunt, kill, take, possess, transport or attempt to hunt, kill, take, transport or possess any deer or parts thereof without proper authorization.
