Illinois Court Affirms State Commission’s Public Utility Finding

The Illinois Commerce Commission properly found that a NextEra Energy Inc. subsidiary was a public utility and wasn’t wrong to order the acquisition of a certificate of public convenience and necessity, a state court said.

GridLiance Heartland LLC qualifies as a public utility under the state Public Utilities Act, the Fifth District Appellate Court of Illinois said Tuesday.

The company owns transmission assets in Illinois connected with transmitting electricity and is required to offer nondiscriminatory services to eligible customers in the state due to its relationship with the local regional transmission organization, Justice Judy L. Cates said.
