Challenge Revived to Oklahoma Transgender Birth Certificate Ban

A lawsuit challenging the constitutionality of an executive order issued by Oklahoma Gov. J. Kevin Stitt (R) that bars transgender people from amending their birth certificates to match their gender identity was partially reinstated by the Tenth Circuit Tuesday.

The plaintiffs allege Oklahoma’s refusal to issue revised birth certificates violates their equal protection and due process rights. The US District Court for the Northern District of Oklahoma dismissed the claims on June 8, 2023.
