Alabama man sues Kraft Heinz, claims lack of lemonade in powder drink mix

An Alabama man has filed a class-action lawsuit in opposition to the Kraft Heinz Meals Firm, claiming there’s a scarcity of lemonade within the firm’s “Nation Time” powder drink combine.

DeMarcus Rodgers filed the swimsuit on April 21 within the Northern District Court docket of Alabama Southern Division. 

In accordance with courtroom paperwork obtained by FOX Tv Stations, Rodgers purchased three canisters of the Nation Time lemonade and pink lemonade drink combine for private use.

He then seen that the drink tasted diluted. Moreover, Rodgers stated he was solely in a position to combine in “six quarts price of powder drink combine as an alternative of the same old eight quarts price of powder drink combine per cannister.”

Rodgers stated he then needed to buy extra canisters to make up the distinction within the powder drink combine.

“Plaintiff has needed to buy extra 19 oz cannisters of Nation Time lemonade and pink lemonade powder drink mixes to make up for the misplaced quantity of powder to make lemonade and pink lemonade to drink,” the lawsuit learn.

Rodgers and his lawyer stated Kraft Heinz misrepresented the quantity of powder combine in a single canister and accused the corporate of false labeling, misleading commerce practices and violating the Magnuson-Moss Guarantee Act and Alabama’s Misleading Commerce Practices Act. 

“Plaintiff wouldn’t have bought the 19 oz cannisters of Nation Time lemonade and pink lemonade powder drink mixes had he identified that they didn’t include sufficient powder drink combine to make eight quarts of drink as acknowledged on the label,” the lawsuit learn.

Rodgers is searching for 3 times the damages for himself and different clients who bought the product. Nevertheless, a certain quantity wasn’t specified within the lawsuit.
