Maine's Top Court Denies Appeal of Trump Ballot Decision
Maine’s Supreme Court on Wednesday declined to rule on whether former President Donald Trump can appear on the state’s ballot.
The decision comes after Maine’s Superior Court deferred ruling on the case after an appeal from the former president’s lawyers pending a decision in a similar case in Colorado. The state’s Supreme Court said it would not hear the case because the Maine Superior Court deferred the decision instead of issuing a final judgment.
The Superior Court judge has determined that Trump can remain on the state’s ballot until after the U.S. Supreme Court issues a ruling on a similar case in Colorado, whose state Supreme Court ruled the former president could be prevented from appearing on the ballot based on the U.S. Constitution’s 14th Amendment, which prevents those who have “engaged in insurrection” from holding public office.
Maine’s Secretary of State Shenna Bellows issued a decision in late December barring the former president from appearing on the ballot, citing the 14th Amendment.
