ND State judge to hear testimony calling trans healthcare ban “unconstitutional”

BISMARCK, N.D. (Valley News Live) – 15-year-old Pamela Roe, along with her father Peter Roe, will be appearing in court alongside Pamela’s doctor, Dr. Luis Casas, in order to testify before a North Dakota State judge at the Burleigh County courthouse.

The testimony will be arguing against North Dakota’s recent ban on gender-affirming care for anyone under the age of 18. This law was passed in April of last year, signed into law by Gov. Doug Burgum. That law later received a request for a restraining order from a family impacted by it, though that request was denied.

Now a different family will be challenging the law, including witness testimony which they hope will support an argument for a preliminary injunction that would allow best-practice medical care to resume for trans youth in the state. According to the plaintiffs, the current health care ban “violates the North Dakota State Constitution by singling out transgender children for unequal treatment under the law.”

This testimony is part of an ongoing lawsuit brought against the State of North Dakota by the Roe family, as well as other families impacted by the law. A complete reading of the complaints in the lawsuit is available here.
